01About these terms

Forgeborn ("Forgeborn", "we", "us", or "our") provides an online platform that lets you generate images, videos, and other media using third-party artificial intelligence models.

These Terms of Service, together with our Privacy Policy, Refund Policy, and Acceptable Use Policy, form a binding agreement between you and Forgeborn. By registering for an account, purchasing a plan or credits, or otherwise using the service, you confirm that you have read, understood, and agree to be bound by these terms. If you do not agree, do not use the service.

02Eligibility

You must be at least 18 years old to use Forgeborn. By using the service, you represent that you meet this age requirement and that you have the legal capacity to enter into this agreement.

If you use the service on behalf of an organization, you represent that you are authorized to bind that organization to these terms.

03Your account

You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us immediately if you suspect any unauthorized use.

You agree to provide accurate account information and to keep it up to date. We may suspend or terminate accounts that contain false information, that are created to abuse promotional offers, or that are used in violation of these terms.

04Payments and Merchant of Record

All purchases on Forgeborn — subscription plans and credit top-ups — are processed by Dodo Payments, which acts as the Merchant of Record for these transactions. This means Dodo Payments is the seller of record: it processes your payment, calculates and collects any applicable sales tax or VAT, issues your invoice or receipt, and handles refunds and payment disputes.

When you make a purchase, you also agree to Dodo Payments' Buyer Terms (dodopayments.com/legal/buyer-terms). Dodo Payments' Privacy Policy applies to the payment information you provide at checkout. Forgeborn does not receive or store your full card details.

Prices are shown in US dollars. Applicable taxes are calculated by Dodo Payments based on your billing country and shown before you pay. Charges may appear on your card or bank statement under the Dodo Payments name.

Chargebacks and payment disputes: if you dispute a Forgeborn payment with your bank or card issuer and none of the credits from that payment have been used, those credits are removed from your account. If any of those credits have been used, we send Dodo Payments and your bank evidence of the service you received, such as your account details, when you accepted these terms, and the content generated with those credits. A dispute does not freeze or close your account and does not cancel your subscription: it keeps renewing until you cancel it from Settings.

05Subscription plans

Subscription plans are billed monthly and renew automatically at the end of each billing period at the then-current price until you cancel. The features, model access, and monthly credit allowance of each plan are shown on our Pricing page.

You can cancel at any time from your account. Cancellation stops future renewals; your plan, its features, and your remaining plan credits stay available until the end of the current paid period. If a renewal payment fails, your plan likewise stays available until the end of the period already paid for.

Subscription fees are refundable only as set out in our Refund Policy: if no credits were used in a billing period, the fee for that period can be refunded on request within 30 days of the payment; once any credit has been used in that period, its fee is non-refundable. If a subscription payment is refunded, the plan ends immediately and the plan credits of that period are removed. If a second individual plan is charged by mistake while you already have an active individual plan, we refund it automatically and cancel it if none of its credits have been used; if any of them have been used, it is not refunded, but it is cancelled so that it does not renew.

Upgrading to a higher plan takes effect once the payment for the new plan is confirmed: the full price of the new plan is charged (no proration), a new monthly billing period starts on that day, your unused plan credits remain available until the new period ends, and the new plan’s monthly allowance is added on top. Downgrading to a lower plan takes effect at your next billing date; your current plan continues until then.

06Credits

Generating content consumes credits. The number of credits required is shown before you confirm each generation and depends on the model and options you choose.

• Plan credits: each billing period your plan’s monthly allowance is added to your account. Unused plan credits do not roll over — they expire at the end of the billing period, and remaining plan credits are removed when your plan ends.
• Top-up credits: one-time credit packs can be purchased while you have an active plan. Top-up credits are valid for 90 days from purchase and remain usable during that time even if your plan ends; without an active plan, only the models available on the Starter plan can be used.
• Promotional credits: credits granted through promotions expire on the date shown when they are granted. Your sign-up bonus stays in your account until that date, even if a plan ends or is cancelled; promotional credits granted together with a plan purchase are removed when that plan ends.
• Spending order: credits are used from your plan allowance first, then promotional credits, then top-up credits, starting with the credits that expire soonest.
• Failed generations: if a generation fails, the credits used for it are automatically returned to your balance.
• Unused credits can be refunded. Once any credit from a purchase has been used, that purchase is non-refundable (see our Refund Policy).
• Credits have no cash value, cannot be transferred to another account, and cannot be exchanged for money except where a refund is granted under our Refund Policy or required by law. Credits in a team’s shared pool belong to that team workspace and can only be used inside it.

07Team and Agency workspaces

Team and Agency plans give a group of people one shared workspace. They are billed per seat every month and renew automatically until the owner cancels. A Team plan needs at least 2 seats and an Agency plan at least 3. Every seat adds its monthly credits to one shared credit pool that all members of the workspace use. A Team or Agency plan is separate from your individual plan: your personal account, its plan and its credits stay as they are.

When a Team or Agency workspace is used to upload or create content that contains personal data of other people, the workspace owner is the controller of that data and Forgeborn processes it on the owner’s behalf. Our Data Processing Addendum applies to that processing and forms part of these terms for Team and Agency plans.

• The owner pays: the person who buys the plan is the owner of the workspace. The owner is responsible for every payment of the workspace and for its seats, and is the only one who can add or remove seats or cancel the plan.
• Owners and admins can see all work: the owner and the admins can see all work created in the workspace by any member, along with its usage and cost reports. Work created in a workspace belongs to the workspace and stays there if a member leaves or is removed.
• Pool credits reset monthly: unused pool credits do not roll over to the next billing period. Top-up packs added to the pool are valid for 90 days, as on individual plans.
• Member limits: owners and admins can give each member a monthly credit limit or pause a member. A member who has reached their limit or is paused cannot generate in the workspace until the limit is raised, the member is resumed or the next billing period starts.
• Seats: a seat you add is charged straight away, and its credits for the rest of the current billing period are added to the pool straight away; from the next renewal it brings its full monthly credits. A seat reduction takes effect from the next billing period; seats removed during a period are not refunded.
• Refunds follow the same rule as individual plans: unused credits can be refunded. Once any credit from a purchase has been used, that purchase is non-refundable (see our Refund Policy).
• If a team plan ends or a payment fails, the team keeps full access until the end of the paid period, then has 14 days of view-and-download access. After that the workspace is locked until the plan is renewed. Nothing is deleted; renewing restores everything.
• Voices cloned in a team workspace belong to that team. The person whose voice was cloned can ask the team, or us at support@forgeborn.ai, to delete it, and it will be deleted.

08Acceptable use

You are responsible for the prompts you submit and the content you generate. Your use of Forgeborn is also governed by our Acceptable Use Policy, which is incorporated into these terms by reference.

You agree not to use Forgeborn to create, upload, or distribute content that:

• is unlawful, defamatory, harassing, or infringes the rights of others, including intellectual property and privacy rights;
• is pornographic, sexually explicit, obscene, or not safe for work (NSFW), including realistic nude imagery of any kind;
• depicts a real, identifiable person without their consent, or is used to impersonate or deceive;
• uses face swapping, deepfake techniques, or face or body manipulation on the likeness of a real person without their consent, or to deceive, impersonate, or mislead others;
• sexualizes minors or depicts child sexual abuse material in any form;
• promotes violence, self-harm, terrorism, or illegal activity;
• is harmful, threatening, abusive, or designed to harass, bully, or intimidate any individual or group;
• attempts to reverse engineer, scrape, overload, or circumvent the technical limits or security of the service;
• resells or redistributes access to the service without our written permission.

09Your content and generated output

"Input" means the prompts, images, and other material you submit. "Output" means the media the service generates from your Input. You retain whatever rights you hold in your Input.

Subject to your compliance with these terms and applicable law, Forgeborn assigns to you the rights it holds in the Output generated for your account, so that you may use it, including for commercial purposes where your plan permits. Because AI models can produce similar results for different users, Output is not guaranteed to be unique, and you are responsible for ensuring your use of Output does not infringe third-party rights.

You grant us a limited license to process your Input and Output as needed to operate the service, provide support, ensure safety, and comply with the law.

10User content and likeness

You are solely responsible for all content you upload or submit to Forgeborn, including images, videos, audio, and prompts.

• By uploading content that shows a recognizable person, you confirm that you have that person’s explicit permission to use their face and likeness to generate content.
• If you upload a photo or video of yourself, you consent to your face and likeness being processed to generate the content you request.
• You may not upload the face or image of another person without their permission, of a celebrity or other public figure, or of anyone under 18 years of age.
• We may remove content that breaks these rules without notice, and suspend or terminate the account that uploaded it.

11Deepfakes and Real People

You may not use Forgeborn to create, edit or distribute deepfakes, face swaps or any synthetic media depicting a real, identifiable person — including public figures — without that person's explicit consent. You may only upload images or videos of yourself, or of people who have given you their explicit consent. Requests that target real, identifiable people are automatically blocked. Violations may result in immediate suspension or termination of your account, without refund, and may be reported to the relevant authorities.

12Voice cloning

You may clone only your own voice, or a voice whose owner has given you explicit permission to clone it. Cloning or imitating anyone else's voice without that permission is prohibited. You are solely responsible for the voices you clone and for how you use them.

13Intellectual property

The Forgeborn platform, including its software, design, trademarks, and content we create, is owned by Forgeborn or its licensors and is protected by intellectual property laws. These terms do not grant you any right to our name, logos, or branding except as needed to use the service.

14Copyright complaints and content removal

We respect the intellectual property rights of others. If you believe content on Forgeborn infringes your copyright, email support@forgeborn.ai with the subject "Copyright notice" and include:

• your name, address, phone number, and email address;
• a description of the copyrighted work you believe is infringed;
• where the content is on Forgeborn (for example, a link), with enough detail for us to find it;
• a statement that you believe in good faith that the use is not authorized by the copyright owner, its agent, or the law;
• a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act for the owner;
• your physical or electronic signature.

15Counter-notice and repeat infringers

When we receive a complete notice, we may remove or disable access to the content and tell the user who posted it. If you believe your content was removed by mistake or misidentification, you can send a counter-notice to support@forgeborn.ai with: your name, address, phone number, and email address; the content that was removed and where it appeared; a statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification; your consent to the jurisdiction of the courts where you live (or, if you live outside the United States, where we can be found); and your physical or electronic signature.

We may send the counter-notice to the person who sent the original notice. If they do not tell us within 10 business days that they have started legal action, we may restore the content.

We close the accounts of users who repeatedly infringe the rights of others. Sending a notice or counter-notice that you know is false may make you liable for damages.

16Third-party models and services

Forgeborn relies on third-party AI providers for generation, along with hosting, storage, authentication, and payment providers. Your use of features powered by these providers may also be subject to their terms. We are not responsible for the availability, accuracy, or output of third-party models, and models and features may change as those providers evolve.

17Beta and experimental features

Some features or models may be marked as beta, preview, early access, or experimental. They may not work as expected, may change or be removed at any time without notice, and may have lower limits or availability. You use them at your own risk, and they are provided "as is" without any commitment that they will continue or become generally available. The credit cost and refund rules shown for these features still apply.

18Disclaimers

The service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. AI-generated Output may be inaccurate, incomplete, or unexpected, and you should review it before relying on it. We do not warrant that the service will be uninterrupted, secure, or error-free.

19Limitation of liability

To the maximum extent permitted by law, Forgeborn and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the service.

To the extent liability cannot be excluded, our total liability for any claim relating to the service is limited to the amount you paid for the service in the three months before the event giving rise to the claim. Nothing in these terms limits liability that cannot be limited under applicable law.

20Indemnification

You agree to indemnify and hold Forgeborn harmless from claims, damages, and expenses (including reasonable legal fees) arising from your Input, your Output, your use of the service, or your breach of these terms or of any third-party rights.

21Suspension and termination

You may stop using the service at any time. We may suspend or terminate your access if you violate these terms or our Acceptable Use Policy, if required by law, or to protect the service and other users. Where reasonable, we will provide notice. Provisions that by their nature should survive termination will continue to apply.

22Changes to the service and terms

We may modify, add, or remove features and models, and we may update these terms from time to time. When we make material changes, we will update the "last updated" date and, where appropriate, provide additional notice. Your continued use of the service after changes take effect constitutes acceptance of the updated terms.

23Disputes

If you have a concern or dispute about the service, please contact us first so we can try to resolve it. Nothing in these terms limits the protection of mandatory consumer-protection laws of your country of residence. Purchases are additionally governed by Dodo Payments’ Buyer Terms.

24General terms

• Severability: if any part of these terms is found invalid or unenforceable, it will be changed only as much as needed to make it enforceable, and the rest of these terms stay in full effect.
• Assignment: you may not transfer these terms or your account to anyone else without our written consent. We may transfer these terms, for example as part of a merger, acquisition, or sale of assets, and will tell you if we do.
• Entire agreement: these terms, together with the policies they refer to (our Privacy Policy, Refund Policy, Acceptable Use Policy, Cookie Notice and, for Team and Agency plans, the Data Processing Addendum), are the whole agreement between you and Forgeborn about the service and replace any earlier agreements on the same subject.
• No waiver: if we do not enforce a right or provision of these terms, that does not mean we give it up.
