01Acceptance of these terms

ForgeBorn ("ForgeBorn", "we", "us", or "our") provides an online platform that lets you generate images, videos, and other media using third-party artificial intelligence models. These Terms of Use, together with our Privacy Policy and Refund Policy, form a binding agreement between you and ForgeBorn.

By registering for an account, purchasing a plan, or otherwise using the service, you confirm that you have read, understood, and agree to be bound by these terms. If you do not agree, do not use the service.

02Eligibility

You must be at least 18 years old to use ForgeBorn. By using the service, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into this agreement.

If you use the service on behalf of an organization, you represent that you are authorized to bind that organization to these terms.

03Your account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately if you suspect any unauthorized use.

You agree to provide accurate account information and to keep it up to date. We may suspend or terminate accounts that contain false information or that are used in violation of these terms.

04Plans, credits and billing

ForgeBorn is offered through subscription plans that include a monthly credit allowance, and through one-time credit packs. Generating content consumes credits at the rate shown before you confirm each generation.

Subscription credits reset at the start of each billing period and do not roll over. One-time top-up credits remain available while your account is active. Prices are shown at checkout and may change with notice for future billing periods.

Subscriptions renew automatically at the end of each period until you cancel. You can cancel at any time from your account; cancellation takes effect at the end of the current paid period. Payments are handled by our third-party payment processor, and we do not store full card details. Refunds are governed by our Refund Policy.

05Acceptable use

You are responsible for the prompts you submit and the content you generate. Your use of ForgeBorn is also governed by our standalone Acceptable Use Policy, which is incorporated into these terms by reference.

You agree not to use ForgeBorn to create, upload, or distribute content that:

• is unlawful, defamatory, harassing, or infringes the rights of others, including intellectual property and privacy rights;
• is pornographic, sexually explicit, obscene, or not safe for work (NSFW), including realistic nude imagery of any kind;
• depicts a real, identifiable person without their consent, or is used to impersonate or deceive;
• involves face swapping, deepfake generation, or any form of face or body manipulation that replaces or alters the likeness of a real person;
• sexualizes minors or depicts child sexual abuse material in any form;
• promotes violence, self-harm, terrorism, or illegal activity;
• is harmful, threatening, abusive, or designed to harass, bully, or intimidate any individual or group;
• attempts to reverse engineer, scrape, overload, or circumvent the technical limits or security of the service;
• resells or redistributes access to the service without our written permission.

06Your content and generated output

"Input" means the prompts, images, and other material you submit. "Output" means the media the service generates from your Input. You retain whatever rights you hold in your Input.

Subject to your compliance with these terms and applicable law, ForgeBorn assigns to you the rights it holds in the Output generated for your account, so that you may use it, including for commercial purposes where your plan permits. Because AI models can produce similar results for different users, Output is not guaranteed to be unique, and you are responsible for ensuring your use of Output does not infringe third-party rights.

You grant us a limited license to process your Input and Output as needed to operate the service, provide support, ensure safety, and comply with the law.

07Intellectual property

The ForgeBorn platform, including its software, design, trademarks, and content we create, is owned by ForgeBorn or its licensors and is protected by intellectual property laws. These terms do not grant you any right to our name, logos, or branding except as needed to use the service.

08Third-party models and services

ForgeBorn relies on third-party AI providers for inference, along with hosting, storage, and payment providers. Your use of features powered by these providers may also be subject to their terms. We are not responsible for the availability, accuracy, or output of third-party models, and features may change as those providers evolve.

09Disclaimers

The service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. AI-generated Output may be inaccurate, incomplete, or unexpected, and you should review it before relying on it. We do not warrant that the service will be uninterrupted, secure, or error-free.

10Limitation of liability

To the maximum extent permitted by law, ForgeBorn and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the service.

To the extent liability cannot be excluded, our total liability for any claim relating to the service is limited to the amount you paid to ForgeBorn in the three months before the event giving rise to the claim. Nothing in these terms limits liability that cannot be limited under applicable law.

11Indemnification

You agree to indemnify and hold ForgeBorn harmless from claims, damages, and expenses (including reasonable legal fees) arising from your Input, your Output, your use of the service, or your breach of these terms or of any third-party rights.

12Suspension and termination

You may stop using the service at any time. We may suspend or terminate your access if you violate these terms, if required by law, or to protect the service and other users. Where reasonable, we will provide notice. Provisions that by their nature should survive termination will continue to apply.

13Changes to the service and terms

We may modify, add, or remove features, and we may update these terms from time to time. When we make material changes, we will update the "last updated" date and, where appropriate, provide additional notice. Your continued use of the service after changes take effect constitutes acceptance of the updated terms.

14Governing law and disputes

These terms are governed by the laws applicable at ForgeBorn's principal place of business, without regard to conflict-of-law rules. You agree to resolve disputes before the competent courts of that jurisdiction, except where mandatory consumer-protection laws in your country of residence provide otherwise.
